Terms of Service

1. Agreement to Terms

By accessing or using Gretelfy ("the Service"), operated by Gretelfy ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and customers of gretelfy.com and its associated APIs and services.

2. Description of Service

Gretelfy is an independent, third-party cookie compliance scanning platform. We scan websites to detect cookies and tracking scripts that fire before user consent, and generate compliance reports with a Gretel Score (0–100) and remediation guidance.

Gretelfy is not a Consent Management Platform (CMP). We do not provide or manage cookie consent banners. We are an independent auditor that verifies whether your existing consent mechanisms function correctly.

3. Accounts

3.1 Registration

To access certain features, you must create an account with a valid email address and secure password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3.2 Organization Accounts

If you create an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. The organization is responsible for all users it adds to its account.

3.3 Account Security

You must notify us immediately at support@gretelfy.com if you suspect unauthorized access to your account. We are not liable for losses caused by unauthorized use of your credentials.

4. Acceptable Use

You agree to use Gretelfy only for lawful purposes. You may not:

• Scan websites you do not own or have explicit authorization to audit
• Use the Service to harass, defame, or harm others
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Circumvent rate limits, usage quotas, or access controls
• Use the Service for competitive intelligence against Gretelfy
• Resell or redistribute scan results without a Ranger (Agency) plan or written permission
• Submit URLs that contain malware, phishing content, or illegal material
• Use automated means to access the Service beyond our documented APIs

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Subscriptions and Payments

5.1 Plans

Gretelfy offers multiple subscription tiers (Scout, Tracker, Pathfinder, Ranger) with different feature sets and scan limits. Current pricing is available on our Pricing page.

5.2 Billing

Paid subscriptions are billed monthly or annually in advance via Paddle. You authorize us to charge your payment method on a recurring basis until you cancel.

5.3 Free Scans

We offer limited free scans on our homepage. Free scans display your Gretel Score and violation count but do not include full violation details or remediation guidance.

5.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial billing periods.

5.5 Refunds

If you are dissatisfied with the Service, contact us within 14 days of your initial subscription for a full refund. After the 14-day period, refunds are granted at our discretion.

5.6 Price Changes

We may adjust pricing with at least 30 days' notice. Price changes apply to the next billing cycle following the notice period.

6. Scan Results and Reports

6.1 Accuracy

Gretelfy scans provide a point-in-time snapshot of cookie and tracking behavior on a given website. Results may vary based on geographic location, network conditions, A/B testing configurations, and website changes. We strive for accuracy but do not guarantee that scan results are complete or error-free.

6.2 Not Legal Advice

Scan results, Gretel Scores, and remediation guidance are provided for informational purposes only and do not constitute legal advice. We recommend consulting with a qualified legal professional for compliance decisions.

6.3 Report Ownership

You retain ownership of scan reports generated for websites you own or are authorized to scan. You may share reports with third parties (e.g., clients, auditors) according to your plan's terms.

7. Intellectual Property

The Service, including its design, code, algorithms, Gretel Score methodology, branding, and documentation, is the intellectual property of Gretelfy and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms and your subscription plan.

8. Privacy

Your use of Gretelfy is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

9. Availability and Support

9.1 Uptime

We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

9.2 Support

Support is provided via email at support@gretelfy.com. Response times depend on your subscription plan.

10. Limitation of Liability

To the maximum extent permitted by law, Gretelfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gretelfy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that scan results will ensure your legal compliance with GDPR, ePrivacy Directive, or any other regulation. Compliance is ultimately your responsibility.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account data after 30 days
• Provisions that by their nature should survive (Sections 7, 10, 11, 12, 14) will remain in effect

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the European Union and the member state in which Gretelfy is established, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts in the jurisdiction where Gretelfy is established.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
